1. Introduction
Upflag ("the Service") is a status page and uptime monitoring platform operated by Christopher Terhune-Testa ("we," "us," "our") based in California, USA. The Service is available at upflag.io.
By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
2. Account Terms
- You must be at least 18 years old to use this Service.
- You must provide a valid email address to create an account.
- You are responsible for keeping your account credentials secure. We can't and won't be liable for any loss or damage from your failure to maintain account security.
- One person or legal entity per account. No sharing accounts across organizations.
- You may not use the Service for any illegal purpose or to violate any laws in your jurisdiction.
3. Acceptable Use
You agree not to:
- Use the Service to monitor URLs you don't own or have permission to monitor.
- Send spam or unsolicited messages through the subscriber notification system.
- Attempt to probe, scan, or test the vulnerability of the Service.
- Interfere with or disrupt the Service or servers.
- Impersonate another person or entity.
- Use the Service to distribute malware or engage in phishing.
- Resell the Service without written permission.
We reserve the right to suspend or terminate accounts that violate these terms.
4. Payment & Billing
- The Service offers a free tier and paid subscription plans (Starter at $15/month, Pro at $39/month).
- Paid plans are billed monthly via Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.
- All prices are in USD. You are responsible for any applicable taxes.
- If your payment fails, we'll attempt to collect for up to 7 days. If payment continues to fail, your account will be downgraded to the free tier.
- We may change pricing with 30 days' advance notice. Price changes won't affect your current billing period.
5. Refund & Cancellation
- You can cancel your subscription at any time from your account settings (Settings > Billing > Cancel Subscription).
- We offer a full refund within 30 days of any payment, no questions asked. Email support@upflag.io to request a refund.
- After 30 days, no refunds are issued. Cancellation takes effect at the end of your current billing period — you keep access until then.
- When you cancel, your data is retained for 30 days in case you change your mind. After 30 days, your monitors, status pages, and incident history are permanently deleted.

6. Intellectual Property
- The Service, including its design, code, and branding, is owned by us. You don't get any rights to our IP by using the Service.
- You retain full ownership of your data (monitor configurations, status page content, incident updates, subscriber lists). We don't claim any rights to your content.
- You grant us a limited license to host and display your content as necessary to provide the Service (e.g., rendering your public status page).
7. User-Generated Content
- You may create status page descriptions, incident updates, and other content visible to your end users.
- You are responsible for the content you publish through the Service. Don't publish anything illegal, defamatory, or infringing.
- We may remove content that violates these Terms or applicable law.
- DMCA: If you believe content on a status page infringes your copyright, contact support@upflag.io with: (1) identification of the copyrighted work, (2) the URL of the infringing content, (3) your contact information, (4) a statement of good faith belief, (5) a statement under penalty of perjury that the information is accurate.
8. Service Availability
- We aim for high uptime but do not guarantee 100% availability.
- We may perform maintenance with reasonable advance notice.
- We are not liable for downtime caused by factors outside our control (hosting providers, network outages, DNS issues, etc.).
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months before the claim.
- We are not responsible for the accuracy of your monitoring results or the availability of the websites you monitor.
10. Termination
- You can delete your account at any time by contacting support@upflag.io.
- We may terminate or suspend your account for violations of these Terms, with notice where practical.
- On termination, we will delete your data within 30 days unless legally required to retain it.
11. Changes to These Terms
- We may update these Terms from time to time.
- Material changes will be communicated via email to the address on your account at least 30 days before taking effect.
- Continued use of the Service after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Any disputes will be resolved in the courts of California.
